The societal challenges posed by the Telecom Act of 1996 and regulatory capture are coming home to roost, like many other ‘Late Lessons from Early Warnings’ chronicled by the European Environmental Agency.
Outdated science (non-thermal effects) and outdated regulation needs a paradigm shift.
BACKGROUND: Court Asked to Free Pittsfield Board of Health to Protect Injured Children and Adults
Highlights:
Verizon turned on a cell tower atop Shacktown neighborhood in Pittsfield, MA.
At least 17 children and adults were injured.
Board of Health investigated and determined their homes are uninhabitable.
The Board of Health consulted with the Massachusetts Association of Health Boards' attorneys who believe the Board of Health is not pre-empted by the Telecommunications Act of 1996. They believe that the TCA only applies to the siting of wireless communication facilities. Once operating in the community, it is the jurisdiction of the Board of Health to ensure the well-being of the citizens and the environment.
Board of Health issued the Emergency Order asking Verizon to come to the table and discuss solutions.
Verizon instead went to federal court and sued the City of Pittsfield.
Pittsfield's former Mayor Linda Tyer and City Council denied the Board of Health the funding needed to fight Verizon in court; the Board of Health was bullied into rescinding the Emergency order.
McCollough Law Firm intervened on behalf of eight of the residents (plaintiffs). The only way to object to the rescission of an Emergency Order in the Commonwealth of Massachusetts is to sue, which is precisely what Scott McCollough did. Dear neighbors, friends, family, supporters; Thank you for all you have done for injured and displaced Pittsfield families. We are humbled by the kindness, care, compassion, fundraising, advocacy, education and efforts each of you have done on our behalf here in Ward 4, and on behalf of the wireless harms issue.
None of this is easy. Our living nightmare has become our new normal, but it shouldn't have to be. With your prayers and continued support, it won't.
Two years ago, Verizon sued Pittsfield on the premise that federal law pre-empted local boards of health from taking action and protecting the health and safety of their communities. Essentially, and I am paraphrasing, they told the city that the local boards of health's hands were tied when it came to finding solutions for those sick and displaced in Shacktown.
We are here to tell everyone that nothing preempts our Massachusetts Boards of Health from doing their job.
Court is Monday at 2 pm, and while we will all be lighting a candle then before the case is heard, we are also holding a prayer circle at 8 pm tonight on Zoom.
Please join us this evening for a short vigil to add your collective thoughts, good energy, prayers and wishes for justice. We know when we work together, anything is possible; including being able to be safe in our own homes.

1. Pittsfield Mayor Peter Marchetti Proclaims June 16, 2024 Electromagnetic Sensitivity Day
Amelia Gilardi, injured and displaced from her home along with her family and neighbors by the radiation from a Verizon cell tower, worked with Mayor Marchetti for her 10th grade civics project to declare June 16, 2024 as Electromagnetic Sensitivity Day.
Amelia, her parents and neighbors were joined by Dr. Kent Chamberlin, above, who served on the New Hampshire Commission to Study the Health and Environmental Effects of wireless radiation.
Thank you, Mayor Marchetti, for standing with residents of Pittsfield, and with the Governors of Connecticut, Colorado, Florida and others across the country and around the world in issuing a recognition of World EMS day.
Now let's see if next year more Massachusetts mayors take this heroic step in supporting awareness, acceptance, education, inclusion and equity by issuing these June 16th proclamations!
